“Obtain legal advice before speaking to the police”
The NSW Police have the burden to prove that you are guilty, you do not have to prove you are innocent. As a person accused of a crime or a suspect to a crime, you are entitled to exercise a right to silence when police are asking investigative questions or asking you to participate in electronically recorded interviews after you have been charged with an offence. You do not have to answer investigative questions by the police and you do not have to patriciate in any electronically recorded interviews.
If you receive a call from the NSW police requesting that you attend a police station or have been stopped by the police, it’s important to get legal advice as it could change the course of your criminal matter significantly.
