The situation faced by the litigants is increasingly common in our society – the man donated his sperm to friends, a lesbian couple, so they could have a child. He was heavily involved in the girl’s life for several years and then the couple decided that they wanted to move to NZ. Was the man simply a ‘sperm donor’ and thus had very few rights to prevent the little girl being shifted out of the country? Or was he a ‘father’ and thus had an influence over this?
