These days parentage testing refers to DNA testing and analysis conducted to confirm or deny the biological parentage of a particular child or person. There can be a variety of reasons why a person may seek parentage testing in family matters. The results of the parentage testing can assist in clarifying issues regarding children’s arrangements and child support.

When would I need parentage testing?

Generally the law says that a person is the biological father of a child if:

  • there is a birth certificate naming that person as the father of the child
  • they have adopted the child
  • they have signed a statutory declaration acknowledging paternity (a legal document which says that he is the father of the child)
  • the child was born while the parties were married or living together
  • the child was born within 44 weeks of a time when the parties were together or within 44 weeks of your relationship finishing for good
  • the court made a decision or orders based on the father being the parent of the child, and these were not overturned (ruled out or stopped).

However, what the law says about who is the father can sometimes be proved wrong by other evidence, including by DNA testing.
