Caldwell Martin Cox Solicitors : Family Law : Child Support

Summary of ways we can assist you:

  • Interpreting and explaining your new Child Support Assessment
  • Advising and representing you in the appeals process
  • Negotiating and drafting private Child Support Agreements between you and your former partner

Child Support

The Australian Child Support system was first introduced in 1988 and has, since 2006, been undergoing a complete overhaul which will more accurately recognise the financial contributions that both parents make to their children. The changes to the system were introduced in three stages, the last of which took place on 1 July 2008. The changes will impact on the 1.4 million separated Australian parents who pay or receive child support.

The Australian Child Support system was first introduced in 1988 and, in 2006, underwent a complete overhaul which more accurately recognised the financial contributions that both parents make to their children. The changes to the system were introduced in three stages, the last of which took place on 1 July 2008. The changes impacted on the 1.4 million separated Australian parents who pay or receive child support.

At that time the Child Support Agency undertook a comprehensive review of all child support cases and new assessments were made. The new assessments are much more detailed and complicated than previous assessments, so contact one of our family lawyers if you would like us to help you to understand the new system.

If you are unhappy with an assessment you have received from the Agency, we would also be happy to give you some advice about the appeals process, including taking the matter to the Social Security Appeals Tribunal.

Private Child Support Agreements

If you have separated from your former spouse and wish to negotiate your own child support payments, we would be happy to help you reach agreement and then formalise that arrangement by way of a private Child Support Agreement. There are two types of Child Support Agreement and so it is important that you obtain proper legal advice from one of our experienced Family Lawyers about which one best suits your circumstances.

For information and assistance on child support issues, please call or email Vicki Andrews of our Family Law Team.
